I can't replicate this.

$ mkdir -p foo/bar
$ touch foo/baz
$ scp -rv foo dtucker at server:foo

creates the foo/ tree on the server as expected.

Could you please attach a tarball of an example directory tree and tell us the
exact scp invocation that exhibits the problem with that directory tree?

Presumably the 4.3p1 is on the cygwin side, what version of OpenSSH is on the
server side?
