I've committed this fix and another one for the scp -3 case. Both fixes
will be in openssh-10.3 - thanks!

    adjust permissions on destination directory only if we created it
or -p was

    upstream: when uploading a directory using sftp/sftp (e.g. during a

    recursive transfer), don't clobber the remote directory permissions
unless
    either we created the directory during the transfer or the -p flag
was set.
