There has been a fair bit of discussion on the openssh-unix-dev@
mailing list on this topic. The default has changed since this bug was
filed and the behaviour around selecting DSCP has been adjusted too.

We don't intend to change behavior or the DSCP values selected at this
time, but if you have new information or cases of ISPs that are badly
handling the defaults that we are using, then please bring them to the
list. Some people there have had quite a bit of success at fixing ISPs
bad handling of marked traffic.
