There are only licensing issues if you are using a implementation from
RSADSI. The OpenSSL implementation (as used by OpenSSH) is not derived
from RSA code, there are also other Public Domain implementations if you
don't like OpenSSL's license.

RSADSI even released rights to the RSA algorithm prior to the expiry of
the patent - check the press releases on their website for details.
